It’s important to note that child support is designed exclusively for the benefit of the children involved, rather than for the benefit of either parent.
Under the Child Support (Assessment) Act 1989 and Family Law Act 1975, each parent — whether they be a father, mother, or non-parent carer — bears the responsibility of financially supporting their child.
Services Australia holds the primary responsibility for administering the child support legislation, as opposed to Federal Circuit and Family Court of Australia. The Court’s authority is limited to making orders in specific circumstances, such as Departure Orders, Child Maintenance Orders, Adult Child Maintenance Orders, or enforcement matters.
Child support agreements can be established during the resolution of other family law matters, such as parenting arrangements, property settlements, or spousal maintenance agreements. In Australia, the obligation to pay child support extends to both biological and adoptive parents, as well as non-parent carers who have assumed responsibility for a child. In some cases, a one-time lump sum payment may be made to fulfil or exceed the assessed child support obligation. Lump sum payments can be beneficial in certain circumstances, providing financial flexibility and certainty for both parties involved.
While child support payments are typically managed through Services Australia, some arrangements may involve direct or indirect payments made by the payer outside of the agency’s purview, for example child care costs, school fees or medical expenses. While these payments are not enforceable, they may be credited up to a certain percentage by Services Australia, providing some level of recognition and accountability.
When it comes to establishing child support arrangements, parents have two types of formal child support options available to them. Parents can choose between an assessment administered by Services Australia, or a Child Support Agreement negotiated between them.
Child Support Agreements can be either limited or binding, offering flexibility and customisation to suit the needs and circumstances of the parties involved.
In certain situations, court intervention may be necessary to establish, modify or enforce child support terms. Court orders such as Departure Orders, Child Maintenance Orders, or Adult Child Maintenance Orders may be sought to address specific issues or circumstances that cannot be resolved through administrative processes.
The process of applying for a child support assessment is administrative and mostly completed online.
To begin, individuals typically initiate the application process by submitting a request to Services Australia. This involves providing pertinent information and documentation to support the application. Upon receipt, Services Australia evaluates the financial circumstances of the parties involved and the care arrangements for the child to determines the appropriate level of child support as governed by legislative guidelines and policies.
Care arrangements are classified into five levels, from below regular care to above primary care. Each level directly impacts the calculation of child support payments, ensuring that the financial obligations accurately reflect the care responsibilities of each party.
As circumstances change, child support arrangements may need to be modified to reflect the current realities of the parties involved. It’s essential to report any changes in income or care arrangements to Services Australia promptly to ensure that child support payments are adjusted accordingly. Failure to report changes may result in inaccurate assessments, estimate penalties and potential disputes.
In cases where parties are unable to reach an agreement through administrative processes, they may in limited circumstances seek court intervention to depart from standard assessments.
Assessment and collection of international child support in Australia depends on whether the other country has a reciprocating agreement with Australia. If so, child support can be administered in the same way as a normal assessment. Australia also has specific child support arrangements with New Zealand.
Where an international child support assessment cannot be made, a parent may seek an international child maintenance order from the Federal Circuit and Family Court. The Court can make any order for child maintenance as it thinks proper, taking into account the need of the child and the financial capacity of each parent to meet that need.
In some instances, child support obligations may continue beyond the child turning 18 years of age, particularly when adult children have ongoing support needs. This is limited to situations where the child has a disability, or when the child is pursuing higher education and requires financial assistance. In these cases, adult child maintenance may be sought to ensure the child’s needs are adequately met.
When determining the amount and duration of adult child maintenance, the court considers several factors to ensure fairness and equity. These factors may include the specific needs of the adult child, such as the nature of the disability, medical costs or educational costs, the financial circumstances of the adult child, as well as the parent’s financial capacity to provide support.
Additionally, the court considers other relevant circumstances such as the direct and indirect costs incurred by the parent that the child lives with.
To ensure compliance with child support obligations, Services Australia utilises a range of mechanisms, including income withholding, enforcement orders, departure prohibition orders and legal action in cases of non-payment.
Child support payments can also have implications for other financial supports, such as Family Tax Benefit Part A payments received by the carer. Understanding these implications is vital when negotiating child support agreements and managing household finances. Changes in child support payments may impact the eligibility and amount of Family Tax Benefit Part A payments, necessitating careful consideration to maintain financial stability for the family unit.
